The date for the court hearing to decide whether there should be a judicial review of the buy to let tax changes introduced by George Osborne has been changed.
The new date is Thursday October 6, and comes after a request from HMRC on the grounds that its lawyers were not available for the previous mid-September dates.
The new October date is when there will be a hearing, estimated to last 90 minutes, which will decide whether landlords Steve Bolton and Chris Cooper can move on to the judicial review.
The landlords and their supporters – including the National Landlords’ Association and Belvoir letting agency – say section 24 of the Finance (No. 2) Act 2015 is an infringement on buy to let investors’ rights. This is the section which concerns the phased reduction in some landlords’ mortgage interest tax relief.
The hearing will now come after the landlords have a scheduled meeting with housing minister Gavin Barwell, expected to take place in early September.
In another development about this long-running saga, there is to be a campaign ‘Axe the Tenant Tax’ seminar and stand at the Property Investor Show on October 7 and 8. Over 6,000 landlords and others from the property sector are expected to attend.
